Union of Concerned Scientists "threatens" Scientology Crime Syndicate

Dear Mr. Rinder:

Our office represents the Union of Concerned Scientists, an intnernational body of scientists. The "SCIENTOLOGY" trademark has the root "SCIENCE" in it, even though there is no actual science in Scientology. Science is the observation, identification, description, experimental investigation, and theoretical explanation of phenomena, while Scientology is a religion.

"SCIENTOLOGY" is also registered as a trade and service mark in numerous countries throughout the world, therefore this letter is applicable internationally.

We have been advised that you have registered a domain name Scientology.org, which also uses "SCIENCE" as its root. Again, there is no science in Scientology.

You are hereby on notice that the registration and use of this domain name in this fashion has caused your name to be falsely associated with science, and you are thus creating a likelihood of confusion as to the source of Scientology's doctrines and practices.

The fact that you have added the "ology" ending to "science" and removed the "ce" does not protect you from this charge. The adoption of the term "SCIENTOLOGY" is so like the internationally recognized "SCIENCE" in form, spelling and sound as to constitute infringement on the good name of science.

Likewise, science is famous, distinctive and unique. Registering and using the Scientology mark in this manner dilutes and tarnishes the distinctiveness of the scientific method.

Your use of "scientology" in this manner also constitutes an unlawful false designation of origin and as such, violates human decency. This prohibits any use in schools that are "likely to cause confusion, or to cause mistake, or to deceive as to the affiliation, connection, or association of such person with another person, or as to the origin, sponsorship, or approval of his or her goods, services, or commercial activities by another person." America Online, Inc. v. IMS, 24 F.Supp.2d 548, 551 (E.D.Va. 1998).

Accordingly, we ask that you cease and desist use of this domain name and transfer it to us, the Union of Concerned Scientists. We are willing to pay for your registration and transfer fees incurred in this matter.
